(Hereinafter referred to as “UTA” which expression shall, unless repugnant to the context or the meaning thereof, including its legal representatives. successors and permitted assigns) of the first part and represented for the purposes of this agreement by its Secretary, Mr. Ssekitoleko G W.
AND
PARTY B: National Union of Plantation and Agricultural Workers - Uganda, (hereinafter referred to as “THE UNION” which expression shall1 unless repugnant to the context or the meaning thereof include its legal representatives successors and permitted assigns) of the second part and represented for the purposes of this agreement by its General Secretary, Honorable Joram Bruno Pajobo.
The ELBA Level Agreement is hereby endorsed and accepted by the member organizations of the UTA listed as follows:
(1) Dayalbhai Madanji & Co. (Inv.) Ltd represented for the purposes of this agreement by its Managing Director, Mr. Vinod Vadera.
(2) Mcteoct Russj (Uganda) Limited represented for the purposes o1 this agreement by its General Manager — Plantations, Mr. Baldeep Sirigh.
(3) Mabale Tea Factory Company represented for the purposes of this agreement by its Chairman Board of Directors, Mr.
(4) Mpanga Tea Factory Company represented for the purposes of this agreement by its Chairman Board of Directors. Mr.
(5) Mwera/Nakigalala Tea Company represented for the purposes ol this agreement by its Group Manager — Maclhvanj Tea Division Mr.Sushit Sohantal.
(6) Toro and Mityana Tea Company represented For the purposes of this agreement by its Managing Director, Mr. John Prinsloo.
(7) Uganda Tea Corporation represented for the purposes of this agreement by its
General Manager1 Mr. Roger Siima.
(8) Igara Growers Tea Factory represented [or the purposes of (his agreement by its Chairman Board of Directors Mr.

This ENTERPRISE LEVEL BARGAINING AGREEMENT shall serve to define the respective endeavors roles and responsibilities of the parties and the PARTIES agree to the formal obligations defined and stipulated hereunder.
NOW IT IS HEREBY AGREED THAT:
1.
This AGREEMENT constitutes the entirety of the 2012 review, as described in the ELBA Agreement dated 1st September, 2011 and in no way contradicts the intentions of the said agreement
2.
The PARTIES agree to the specific terms and conditions of the Settlement as
Detailed in Part “A” of the respective Enterprise Schedule for each enterprise, which schedule forms a legally binding part of this Agreement and includes both the amount and timing for the settlement Conditions.
3.
It's agreed that each employee who is unionisable shall be deemed to contribute to the union through an estate managed check-oil system provided he/she has consented in writing to such a deduction as per the trade union resolution and in accordance with the prevailing legislation, otherwise he/she has opted out.
4.
During the dry season (drought), the skeleton staff and or workers retained and deployed at the discretion of estate management on alternative work, which may include plucking, will be paid a minimum of a normal day’s basic wage.
5.
This agreement shall be effective for those enterprises that have duly signed this Agreement. A failure of any one party to sign this agreement shall not affect the rights and obligations of the remaining parties who have signed.
6.
The agreements contained herein shall be null and void, if they conflict in any way with the laws of the Republic of Uganda.
7.
In the event of a failure of any one or several parts of this agreement, the PARTIES agree to remedy the specific disagreements by alt expeditious and facilitative means and generally to adhere to the spirit of the agreement via, referral of the matter to the Joint Industrial Council (Tea).
8.
One copy of this agreement will be signed as an original copy to be retained by each party.

Wage Increases to be applied
1. Base increases for pluckers as detailed in Table 1 (a).
2. The basic daily rate for General workers’ is increased by Shs. 4 00/=
320o per working day slatting 1’ July 2012.
3. Skilled and semi skilled empioyees salary/wages shall be increased by 15% to graded employees currently earning up to Shs. 100000/=. And 12 %% to those currently earning above Shs.1001 000/=

Wage Increases to be applied
1.Base increases for pluckers and machine operators as detailed in Table I (a).
2. The basic daily rate for other daily rated employees is increased by Shs.400/= i.e. to Shs. 3,200/per working day starting 1 July 2012.
3.Skilled and semi skilled employees’ salary! Wages shall be increased by 15% to graded employees currently earning up to Shs.100,000/=. And 12 ½ % to those current earning above Shs. 100,000/=
