COLLECTIVE BARGAINING AGREEMENT BETWEEN MEMBERS OF UGANDA FLOWER EXPORTERS ASSOCIATION LTD (UFEA) (HEREIN AFTER REFERRED TO AS "EMPLOYERS") WHO ARE SIGNATORIES TO THE RECOGNITION AND PROCEDURAL AGREEMENT AND UGANDA HORTICULTURAL ALLIED WORKERS UNION (UHAWU)( HEREIN AFTER REFERRED TO AS THE "UNION") FOR AND ON BEHALF OF WORKERS IN MATTERS OF WAGES AND SALARIES

1. PREAMBLE

An agreement made on this 23 day of May 2012 between members of UFEA

And The Uganda Horticultural and Allied Workers Union Whereas:

In entering this agreement both the Union and Employers appreciate that it is in their interest to have productive, continuous and reliable employment and good service delivery to all concerned.

The Employer and the Union hereto are desirous to maintaining good and normal working relations in the flower industry, by introducing better arrangement for wages/salaries

The Employer and the Union having already signed the Collective Bargaining Agreement for terms and condition of service, the Collective Bargaining Agreement for wages and salaries (Phase II) May 2011, and now wish to sign the collective Bargaining agreement for salaries and wages (phase III) May 2012; the parties, NOW DO HEREBY MUTUALLY AGREE AS FOLLOWS:

2. SCOPE

In this Phase III of the Collective Bargaining Agreement wages and salaries increment for 2012 for lowest category has been considered. 

3. SALARIES AND WAGES

It was agreed that the following salaries and wages be implemented immediately:

(a)Employees earning less or equal to Ushs 150,000 per month and who has completed the six month probation period as stated in the CBA for terms and conditions of service (i.e. who are permanent employees) will get 8% increment in addition to what they have earlier received after the last CBA salaries wage of May 2011 in form of allowances and/or benefits in agreement/consent with the union.

(b)Employees earning above Ushs. 150,000 per month and who has completed the six month probation period as stated in the CBA for terms and conditions of service (i.e. who are permanent employees) will get a 6% increment in addition to what they have earlier received after the last CBA salaries wage of May 2011 in form of allowance/benefits with agreement/consent with the Union.

4. IMPLEMENTATION

The implementation date for the year 2012 is 1st April, 2012 -31 March 2013, As agreed on in the Phase II negotiation, Wages and salaries shall be reviewed every year and negotiations shall take place between January and March.

5. GRATUTITY

The CBA Terms and condition of service defined Gratuity as "the voluntary payment in appreciation given to an Employee under an established scheme in recognition of good conduct by the employee during his/her terms of service. It is agreed that only those Farms currently with a GRATUITY scheme will continue to do so.
