Who is entitled to annual leave?

All employees who have performed continuous service for their employer for a minimum period of six months or those who normally work under a contract of service for sixteen hours a week or more are entitled to annual leave.

What happens in case an employee’s employment is terminated before he or she has got his or her leave?

The employee is entitled to receive a holiday with pay proportionate to the length of service for which he or she has not received, or any other compensation instead of the holiday.

How many annual leave days is each employee entitled to?

Each employee is entitled to twenty one annual leave days each year with full pay at the rate of seven days in respect of each period of a continuous four months’ service. An employee can take his or her annual leave at any time during a particular calendar year depending on what he or she has agreed with the employer.

What more should an employee know about leave days?

The twenty one (21) days only include working days. For example, if an employee does not normally work on Saturday and Sunday they cannot be counted as part of the leave days.

Public holidays are also not part of leave days and in case an employee has worked on a public holiday, he or she is entitled to a day’s holiday with full pay at the expense of the employer on some other day that would otherwise be a day of work. However, an employee may forfeit this in favour of pay at not less than double the rate payable for work on a day that is not a public holiday.

Annual leave days cannot be carried forward into another calendar year unless it has been agreed with the employer by mutual consent. To avoid disturbances and in order to boost efficiency, it is advisable to take annual leave within the same calendar year in which an employee is entitled to it.

Can annual leave days be accrued? If so, how?

Yes. An employee may decide to take all the twenty one leave days at once. However, this is only possible with the consent of his or her employer.

What about pay and annual leave – do workers get paid? If so, how much?

Yes. An employee is entitled to full pay when he or she takes his or her annual leave. The pay should be the same as before the leave was taken. However, if a salary increment was effective during the course of an employee’s leave he or she should benefit from it.

What if a worker gets sick during annual leave – is this counted as sick leave or annual leave? How does this work?

In case an employee gets sick during annual leave, it will still be counted as part of annual leave and not sick leave. However, if the sickness persists beyond the annual leave, then the employee is required to inform the employer and subsequently request for sick leave.
